Driving While Under the Influence of Alcohol is an offence under the Road Traffic Act 1988 s.5(1)(b). You can also be charged with Driving When Unfit Because of Drink or Drugs under the Road Traffic Act 1998 s.4(1). A police officer may request to carry out a breath test for excess alcohol, but only if they have reasonable cause to do so. Where a police officer has reasonable cause they are authorised to request a test even if they are not in uniform. However, an officer can only administer the test while in uniform, unless it is following an accident.
What are the Penalties for Drink Driving?
Conviction could mean you are issued 3 to 12 penalty points on your licence, a fine of up to £5,000, or even a prison sentence of up to six months. Early legal advice can help to decrease a sentence, and could mean the difference between a conviction and an acquittal.
How Long Does a Ban for Drink Driving Last?
There is an obligatory disqualification from driving for a period of 12-36 months depending on aggravating or mitigating factors surrounding the incident. This period of disqualification can sometimes be reduced by agreement and attendance at rehabilitation courses for drink driving. It may also be possible with longer bans, to apply to the court for the ban to be reduced where there are special circumstances to consider, such as a new job that requires driving, or relocation to a rural area. Proof that you have attended an alcohol abuse class may help your claim.
