The Misuse of Drugs Act defines how different controlled drugs are classified. The classification of a drug affects how serious a drug offence is, and what the possible sentence could be if you are guilty of a drug offence.
Class A drugs are the most serious types of drug that the Courts can deal with. This includes heroin, cocaine, crack cocaine, ecstasy (MDMA), methamphetamine, LSD and psilocybin (magic) mushrooms.
Possession of a Class A drug can carry a 6 month prison sentence in the Magistrates Court or 7 years imprisonment in the Crown Court. Supply of a Class A drug is almost always dealt with in the Crown Court and can carry a maximum sentence of life imprisonment.
Class B drugs include amphetamine, mephedrone, and cannabis. Possession of a Class B drug carries a maximum sentence of 3 months imprisonment in the Magistrates Court or 5 years imprisonment in the Crown Court. The offence and possession with intent to supply a Class B drug carries a maximum of 6 months imprisonment in the Magistrates Court or 14 years in the Crown Court.
Class C drugs include GHB, Ketamine, Diazepam and frequently prescribed tranquillisers. The maximum sentence for possession of Class C drugs is 3 months in the Magistrates Court and 2 years in the Crown Court. Supply of Class C drugs carries a maximum of 3 months imprisonment in the Magistrates Court and 14 years in the Crown Court.
